Building strategies for successful out of court settlements and trial awards Mr. Holness has many examples of success. Winning double costs for his client, a Supreme Court judge described his work as a “comprehensive settlement proposal” which included a “detailed analysis of the facts and the relevant case law regarding each head of damage.” In 2021 Mr. Holness again was awarded double costs by beating offers made before trial. A Supreme Court Judge stated that the offer Mr. Holness had made to ICBC, “was one that ought reasonably to have been accepted…Had the offer been accepted, a four-day trial would have been avoided”. Past results are not necessarily indicative of future results and the amount recovered and other litigation outcomes will vary according to the facts in individual cases.
