The law in British Columbia provides a mechanism whereby persons who sustain injury or loss in British Columbia caused by an uninsured motorist may receive compensation from ICBC. The law outlines the conditions that must be met to gain an entitlement to damages and also sets out the procedures that must be followed by a claimant in presenting a claim and by ICBC in defending a claim. The law limits the total liability of ICBC to $200, 000 for all uninsured claims that arise out of the same accident, including claims for prejudgment interest, post judgment interest, and costs. The law also requires the deduction of “any benefit, right to indemnity or claim to indemnity accruing to a claimant” when calculating your entitlement under s. 20 of the Insurance (Motor Vehicle) Act. The contemplated benefits include workers’ compensation, employment insurance, and government benefits.
